Version v1-2026-11-02 · Effective November 2, 2026 · Companion to the Terms of Service v1-2026-11-01

This Assumption of Risk, Waiver and Release ("Release") applies to in-person Valley Boys coaching, training, and athletic activities, including evaluations, lessons, training sessions, programs (including VELO+ and J-Band work), camps, tryouts, and any other physical activity conducted by Valley Boys coaches or staff (collectively, "Activities"). It is a separate document from the Terms of Service: accepting the Terms alone does not constitute acceptance of this Release, and this Release governs physical participation as provided in Terms §28.

1. Who signs

2. Voluntary participation; inherent risks

Participation in the Activities is voluntary. The undersigned acknowledges that baseball and athletic training involve inherent risks of injury that cannot be fully eliminated, including but not limited to: being struck by a thrown, batted, or batted-ball-equipment object; collisions with other participants, equipment, or facility features; slips, trips, and falls; muscle strains, joint injuries, and overuse injuries (including arm and shoulder injuries associated with throwing); heat-related illness; and injuries arising from the participant's own physical condition, fatigue, or failure to follow instructions.

The undersigned assumes all such inherent risks, whether or not described above.

3. Health responsibility; no medical advice

Valley Boys provides training, educational, informational, and technology services. It does not provide medical diagnosis, treatment, physical therapy, or individualized medical advice (Terms §12). Before participating, the participant (and, for a minor, the parent or guardian) is responsible for considering the participant's health and physical condition and obtaining medical clearance when appropriate.

If a participant experiences pain, dizziness, illness, injury, or other concerning symptoms, the participant must stop the activity and seek appropriate medical attention. Coaches may stop a participant's activity at their discretion for safety reasons.

4. Waiver and release

To the maximum extent permitted by Arizona law, the undersigned, on behalf of themself (and, for a minor participant, on behalf of the participant) and their heirs, executors, and assigns, waives and releases Valley Boys and its members, officers, employees, agents, and coaches (collectively, "Released Parties") from claims, damages, and liability arising from participation in the Activities, including claims based on the ordinary negligence of a Released Party.

This Release does not release claims based on gross negligence or willful misconduct, and does not limit or exclude any liability that cannot lawfully be limited or excluded. If any part of this Release is unenforceable — including any part concerning a minor's claims, which Arizona law treats restrictively — that part will be reformed or severed to the minimum extent necessary, and the remainder continues in effect.

5. Medical authorization

In the event of injury or illness during an Activity, the undersigned authorizes Valley Boys staff to administer reasonable first aid and to summon emergency medical care, including transport to a medical facility. The undersigned understands that any resulting medical costs are the responsibility of the participant (or, for a minor, the parent or guardian), and that Valley Boys does not carry participant medical insurance.

6. Indemnification

To the extent permitted by law, the undersigned agrees to indemnify and hold harmless the Released Parties from third-party claims, damages, liabilities, and reasonable costs arising from the undersigned's material violation of this Release or applicable safety rules, or from the participant's unlawful or fraudulent conduct. This provision does not require a consumer to indemnify Valley Boys for Valley Boys' own conduct where such indemnification is prohibited by law.

7. Rules and conduct

The participant agrees to follow Valley Boys safety rules and coach instructions, to use equipment as directed, and to disclose any injury, illness, or physical limitation that could affect safe participation. Valley Boys may remove a participant from an Activity for unsafe conduct or for a safety concern, without refund except as provided in the Terms (§7, Cancellations and refunds).

8. Governing law; disputes

This Release is governed by Arizona law. Disputes arising from this Release are resolved under the dispute-resolution provisions of the Terms (§22, Dispute resolution; arbitration; class-action waiver), which are incorporated here by reference. If a provision of this Release conflicts with the Terms for a particular Activity, the more specific provision governs that Activity (Terms §28).

9. Acknowledgment

By signing, the undersigned confirms they have read this Release, understand that it affects legal rights (including the right to bring claims for injuries), and sign voluntarily. A copy of this Release will be made available on request to info@valleyboysbaseball.com.

Acceptance

This Release is accepted by signing a copy (paper or electronic) kept on file by Valley Boys. The signed copy records: participant name and date of birth; parent or legal guardian name and relationship to the participant (required if the participant is under 18); signatures; and dates.
